An elderly relative in the UK named me as his main benefactor (not sure if that's the right word) in his Will (should it be capitalised?) several years ago. Now I've moved overseas, he wants to amend my address in his Will and has asked me to get an indication of what he needs to do and approximately what a solicitor would charge for this service. (Needless to say, I will happily pay the charges.) Any idea?
I don't think he need do anythying except have a note of your new address plus other contact details (incl email address) kept with the will. People move around - isn't necessary to change the will each time.
The executors just need to know how to contact you.
I agree. The address is there only for contact purposes. Just let the people who are holding the will (and better this comes from your relative as testator/testatrix) of your current contact details. Even then only worth doing if they have changed significantly (like overseas).
BTW the Benefactor is the person giving a benefit. The Beneficiary is the recipient of the benefit. Being the latter can be great, but that can often come with being the Executor also (the one charged with the legal responsibility of ensuring that the terms of the will, and other Estate matters, are performed) - and that can be a lot of work.
If one really wants to amend a will simply to update addresses then since your relative is in the UK then any amendments would have to be signed there; it therefore would make the most sense to have the codicil (amendment) done by a lawyer in the UK. We believe however that except for emergencies a NEW will is a much idea than a codicil since drafting an updated will clearly brings the Testator's attention to ALL the facts of his then present situation.
IF your relative simple puts a copy of your CURRENT address with his current will this will serve the purposes equally as well; should he have a copy of his will with his solicitor then a copy there would be the cheapest and most efficient way to deal with the minor matter of your address change.
