I need to break my lease, only 5 months left.My landlord wants me to advertise the apartment at $5,000 more per month than I presently pay.he intends to start a new lease.
The advice I need is...can I legally advertise as a "break lease" at the same price I now pay? (rather than what the landlord wants me to do)It would be alot easier for me to find someone just to take over the lease for the final 5 months.

On the assumption that your lease prohibits assignment or subletting, your landlord holds all the cards. Effectively, he is saying: "I will release you if you find another tenant for a higher rent". Which, quite frankly, seems fair enough.
So you couldn't advertise a "break-lease" because you would need your landlord's permission which, it would seem, will not be forthcoming. I think you will just have to "bite the bullet" and find another tenant at an increased rent.
